No exclusive rights to the geographical indication “Gruyère” in the U.S.A.

The term “gruyère” cannot be protected as a trademark in the United States. This was ruled by a federal court in Virginia on December 15, 2021. The decision is grounded on the reasons that this name is found generic. Said geographical indication, which is protected in Switzerland and in Europe, is therefore free to be used in the United States. Any cheese producer can use this name on the American territory. The Swiss Interprofession du Gruyère and the Syndicat Interprofessionnel du Gruyère de France appealed this decision on the 7th of January. More to follow.
