EU decision refusing to grant the trademark for the shape of Moon Boots after-ski footwear

The shape of the renowned Moon Boots snow boots was recently denied trademark rights at European Union level. On January 19, 2022, the General Court found that this shape does not depart enough from the other shapes in the after-ski footwear sector. As such, the aesthetic features lack distinctiveness for the relevant goods and therefore cannot be granted trademark protection. The same decision was issued in Switzerland some years ago. Against copies, copyrights remain a defensive tool but the protection conferred by the latter is different.
