On October 14, the Federal Council opened a consultation procedure on the partial revision of the Patents Act aiming at adapting the patentability requirements of Swiss patents to international standards. In particular, it is proposed that only inventions which are new and innovative should get protected. As a result, the Swiss patent would undergo a substantive examination as is the case for European patents. The project also introduces a utility model, without a substantive examination and with a shorter term of protection. The consultation will last until 1 February 2021.
