New article “Relaxation of the examination of Swiss trademarks containing an indication of source”

A significant change in practice has come into effect on March 1, 2022 regarding the examination of trademarks filed for a sign containing an indication of source. For these trademarks, the Swiss Federal Institute of Intellectual Property has abandoned the requirement of a limitation to the geographical origin of the goods and services on the grounds of a risk of deception. The limitation is now only required for protected geographical indications, and on the basis of the violation of the law in force.
