Arrival to destination for Bulli van! Last November 29, the European Union Intellectual Property Office issued a decision in favor of Volkswagen Aktiengesellschaft (Case R 2421/2020-1). The application for a three-dimensional trademark on the shape of the van was considered distinctive and therefore eligible for protection. The examination of the trademark is again underway and the registration is expected in the coming months. This trademark will allow its owner to claim exclusive rights over the aesthetic features of this shape against copies. In Switzerland, a trademark on the same shape was refused registration in 2012 for lack of distinctive character.
