Isabelle Bruder and Nathalie Denel were very pleased to attend the roundtable held by International Trademark Association (INTA) in Geneva last Tuesday. The Swiss Federal Institute for Intellectual Property applies rather strict standards when assessing the prima-facie evidence of use in opposition or non-use cancellation proceedings. Even compared to the practice of civil courts, where full evidence is required, the standards are high. These standards were discussed in depth on the basis of case law. The discussion was full of learnings with an open and pragmatic exchange between participants. The same roundtable will take place in Zurich on November 8.
